ASDA @t home aims to give you a superb home shopping service. We have set out below the guidelines to let you know what you can expect from us and see the terms on which you place your order. We know it’s a lot of legal stuff, but its been written by top lawyers at huge expense to us, to protect You, so please do read it. "You" and "Your" means the person ordering Goods from Asda, who must be over 18 years of age.

"Asda or "We" or "Us" or "Our" means Asda Stores Limited whose registered office is at Asda House, Southbank, Great Wilson Street, Leeds, LS11 5AD..

“Let Us Know” means visit Our Site and amend or cancel Your order, call Our order helpline shown on the Site with Your customer number. You may also write to us at or fax us on, but this is the slowest and most expensive way for us to deal with Your changes so please try and help us keep costs down and prices low by visiting Our Site or using our order helpline.

"Site" means Our grocery shopping website at www.asda.com and for the avoidance of doubt excludes purchases of financial services products, and purchases from other areas of Asda.com including entertainment and other products.

1 Becoming a Customer

1.1 To register as a customer You must be over 18 years of age, live in Our delivery area and have a credit or debit card acceptable to Us in Your name.

1.2 When You register You will be given a unique customer number and You will choose a PIN No which You must use whenever You shop with Us. Please keep these in a safe place.

1.3 We reserve the right to decline a new customer registration or cancel registration at any time.

2 Our Contract and the Products

2.1 Our site invites You to buy products from Us. Once you have placed an order on the Site we will send you an order acknowledgement by email setting out what you have ordered with the in-store prices on the day of order. This is not an order confirmation or acceptance from Us. A legally binding contract with You will only arise once We have completed delivering the products to You. At this time You become the owner of the products.. This means that You will have no legal liability in connection with Your order until delivery is completed.

2.2 These terms regulate the supply of goods to You by Asda. Any other terms, conditions or representations (other than those made fraudulently or implied by statute) are excluded.

3 Price

3.1 Prices on the Site are the prices charged in store on that day and as the store prices change we update the Site overnight. They are therefore a guide only. There may be some slight variations by the time We are due to deliver Your order. When You shop on the Site You will pay the same price that you would pay if you came to Our Store (excluding promotions) to do your shopping on the day of delivery. If you are unhappy with the price of any products once Your order is delivered please let us know and we can arrange a refund. You can either tell our driver when he makes the delivery or contact us within 7 working days after the day of delivery. In these circumstances we need you to look after the products as set out in clause 4.2 below.

3.2 As it is difficult to buy loose items such as fruit, vegetables, meat and poultry etc to an exact weight, We'll charge You for the actual weight delivered - and We always try and get as near as possible to the weight You ordered.

3.3 In addition to the price, a delivery charge between £3.75 and £4.75 will also be payable by You. There is a minimum order value of £25.00.

3.4 We will debit the price, plus any delivery charge, from Your debit or credit card when We are ready to dispatch Your goods.

3.5 All prices quoted are inclusive of any Value Added or other tax

3.6 All transactions will be handled by Asda CS Limited who will retain 2.5% of the total shown. The balance of 97.5% will be paid to Asda Stores Limited. The total payable by a customers will be the same regardless of the payment method.

4 No Excuses Guaranteed

4.1 You can change your mind about purchasing products or withdraw or change Your order at any time. Because of how our systems work if You want to add products to Your order and keep the same delivery date You need to Let Us Know before 5pm on the day before Your order is due to be delivered, otherwise we can’t process the change in time.

If You want to remove products from Your order or cancel it altogether it is preferable if You Let Us Know before 5pm on the day before Your order is due to be delivered as We will then not add those products to Your order or not put Your order together. This helps us keep our costs down and our prices low and frees up delivery slots for other customers. However if You forget simply tell the driver when he delivers Your order he will take away the products You don’t need.

4.2 Of course You can change Your order anytime up to delivery, but that will mean that We won’t necessarily be able to deliver during Your selected delivery window and We would need to agree another time and day. But do ask us anyway as We will try and accommodate You.

4.3 If the quality of any of Our products is not to Our usual high standards We will happily refund the money. If this is any ASDA own branded food product (including labels such as Smart Price and Extra Special and any of our Asda branded fresh produce) we will refund you double the price of the product. Please Let Us Know as soon as possible after You receive Your order. But remember we need to receive this within 7 working days after the day you received Your order. You must store the goods in the manner appropriate to the type of goods (eg keep chilled items chilled, frozen item frozen) as We may require them to be returned and they must be returned to Us in the same condition as they Were delivered to You.

4.4 Other than for any products set out in clause 4.3 or which by reason of their nature can not be returned or are liable to deteriorate, or expire rapidly, You may also cancel Your order at any time up to 7 working days from the day after the day the goods are delivered to You. Please Let Us Know We will then let you know whether you are able to cancel. You must store the products in a manner appropriate to the type of products as explained in clause 4.3 above. Other than for products which are faulty when we deliver them to You, We may require You to return products at Your cost and in the same condition as they were delivered to You.

4.5 You cannot return newspapers and magazines, video’s, dvds, cd’s, tapes or computer games if the security seal has been broken unless such items are faulty. Your rights under consumer legislation for these products are not affected.

4.6 If You return products or cancel Your order under this clause 4 and We have already debited Your card We will reimburse any sum received from You in respect of such products the next working day by crediting the card You paid with.

5 Stock Shortages on Popular Products

5.1 We do our best to ensure that we have amazing availability but We do occasionally run out of some products. When You place Your order We will ask if You Would like Us to substitute an alternative similar product if Your chosen products are not in stock at the time We dispatch Your order. If You do and when You receive Your order, You are not happy with the substitution, please Let Us Know as soon as You can so that We may handle this in accordance with clause 4.2. Our drivers are trained to take You through the substitutions on the doorstep so if You let the driver know s/he will take the products away at that time.

6 Delivering Your Goods

6.1 We always aim to deliver Your products within the delivery slot We have agreed with You, but We cannot accept liability if We deliver the products outside of this slot or don’t deliver all or any of the products in Your order.

6.2 Ownership of, and risk in, the products will pass to You once we have finished delivering Your order to You.

6.3 We can only deliver to Your registered address.

6.4 If there is no one at the delivery address who is 18 years of age or over, We'll leave notification of Our visit and will return the products to Our store. We'll then contact You to arrange re- delivery at a convenient time. We may charge another delivery charge for this.

6.5 Due to licensing restrictions We can only deliver alcohol during the licensing hours that are within Our delivery times. These will vary by store but are currently 8am - 10pm Monday to Saturday and 10am - 10pm Sunday.

7 What We are Not Liable For

7.1 Whilst We take every care to deliver Your order We cannot be liable for any indirect or consequential loss or damage or loss of profits arising out of Our supply or failure to supply the products to You.

7.2 Clause 7.1 does not in any way limit Our liability for death or personal injury resulting from Our breach of contract, tort or negligence nor limit any legal rights You have as a consumer.

8 Use of Cards

8.1 In the unlikely event that unauthorised use is made of Your credit card, most card issuers either cover all the charges that result from the unauthorised use or may limit Your liability to £50. If Your credit card issuer holds You liable for any of this £50 we will reimburse You up to the full £50. This guarantee applies where the unauthorised use is as a direct result of You giving Us Your credit card details on our secure server and not through Your own fault.

8.2 If You find Your card has been used without your authority please tell us within 24 hours of finding out. You must also tell Your card issuer within the time limits You agree in Your card scheme rules.

9 Governing Law

9.1 This contract is subject to English law and the exclusive jurisdiction of the English courts.

10 Changes to these Terms

10.1 If We make any changes to these terms We will let you know as soon a possible by posting the changes on Our Site – and we will update the date shown below.

11 Expiry Dates

11.1 The colleagues who put together Your order are carefully trained to select products with a reasonable amount of time left on the expiry date (just as you would if You were in store shopping Yourself). However, please note that some fresh produce items naturally only have an expiry date of one or two days from the day they arrive in the store, therefore it is reasonable for them to have a shelf life of less than two days when they are delivered.
